Condition of use

  1. General Items – Scope
    1. These terms and conditions are valid for all present and future business relations between Tiron Service GmbH & Co. KG and the customer. Exclusively relevant are our General Terms and Conditions Tiron (AGB Tiron) in the online version available at time of the contract conclusion. These terms and conditions can be printed out or saved in reproducible form by the customer at will.
    2. Only contents in writing shall be valid. Oral additional agreements have not been made. Changes of contract have to be in written form. This shall also be valid for the abrogation of this written form which has been contractually agreed. Deviating, conflicting or additional terms and conditions shall not, even on notice, become part of the contract; unless their validity is expressly consented to.
    3. Consumer in the context of these terms and conditions are natural persons with whom a business relation is established without attributing them a commercial or self-employed occupational activity. Entrepreneur in context of these terms and conditions are natural persons or legal entities or private companies having legal capacity with whom a business relation is established, which act in performing a commercial or self-employed occupational activity. Customers according to these terms and conditions are consumers as well as entrepreneurs.
    4. Deviating, conflicting or additional General Terms and Conditions of the customer shall not, even on notice, become part of the contract, unless their validity is expressly consented to in writing.
  2. Conclusion of contract, placing of orders

    1. Our offers are not binding. Technical as well as miscellaneuos changes are reserved within the bounds of reasonability.
    2. By placing the order the customer bindingly declares his offer of contract. The Tiron Service GmbH & Co. KG shall confirm the receipt of the order of the customer immediately, if the order has been placed within the scope of the online shop at the internet at www.tiron.de. The confirmation of receipt still represents no acceptance of the order. But the confirmation of receipt can be linked with a declaration of acceptance.
    3. The Tiron Service GmbH & CO. KG is entitled to accept the offer of contract included in the order within three working days after receipt. We are entitled to refuse acceptance of the order – for example after checking the creditworthiness of the customer.
    4. The services to be performed shall be indicated in a confirmation letter and the estimated completion date or rather delivery date shall be stated.
    5. The conclusion of contract shall be subject to the correct and punctual delivery to us by the suppliers of the Tiron GmbH. The customer shall be informed about the unavailability of the service immediately. The service in return, as far as already performed, shall be refunded immediately.
    6. If the customer is consumer in terms of number 1.c) of the General Terms and Conditions Tiron (AGB Tiron) and the goods are ordered electronically, the wording of contract shall be saved by the Tiron GmbH and send to the consumer together with the present General Terms and Conditions via e-mail.
  3. Estimation of costs / preliminary work

    Estimations of costs and preliminary work like preparation of service specifications, proposal documents, plans, drawings and models that are requested by the customer, shall be obligatory to remuneration due to agreement. If an order is placed due to the estimation of costs, possible costs for the estimation of costs and the costs for possible preliminary work shall be settled with the order invoice.

  4. Time of delivery and performance / shipping and handling

    1. Delivery dates or delivery periods which can be agreed upon bindingly or non-bindingly, need to be in writing. If not expressly agreed otherwise, dates shall be non-binding.
    2. Delays in delivery and performance due to force majeure and due to events which complicate the performance significantly or make it impossible for the Tiron GmbH, also if they occur at suppliers of the Tiron Service GmbH & Co. KG or its sub-suppliers, shall not be substituted by the Tiron Service GmbH & Co. KG, even at bindingly agreed upon periods and dates. You entitle the Tiron GmbH to postpone the delivery or rather performance by the duration of the interference plus an appropriate acceleration time or to withdraw completely or partly from the contract on account of the part not yet performed.
    3. The Tiron Service GmbH & Co. KG is entitled to render partial delivery and partial performance at any time.
    4. Delivery shall take place at the expense of the customer and to the delivery address indicated by the customer.

    Orders are combined per packet up to maximal 31,5 Kg.
    Additional value insurances above 500 € are charged separately.
    Special conditions are negotiated with the contract partner individually.

  5. Acceptance of delivery

    1. The customer is obliged to immediately declare the acceptance of delivery after successfully checking the services performed according to the contract.
    2. The acceptance certificate is carried out in written form in an acceptance protocol. The unreserved usage of the goods (real operation) however is equivalent with accepting the good.. The acceptance shall also then be considered as given, if the client did not announce substantial defects in writing after expiration of 14 working days since the declaration of willingness of acceptance by the seller.


  6. Right of return for consumers

    1. You can return the goods without giving reasons within two weeks by reshipment of the goods. The period shall begin soonest with receipt of the goods and this instruction. Only for goods that cannot be send in a packet (e.g. bulky goods) you can declare the return also by demand for return in written form, thus e.g. via phone, fax or e-mail. To meet the period, timely mailing of the goods or the demand for return shall suffice. The reshipment or the demand for return shall be made to:
